Terms of Use
These Terms govern your use of the ScoreMark iOS app and the website at scoremark.app (together, the “Service”). By downloading, accessing, or using ScoreMark, you agree to these Terms.
The Service
ScoreMark lets you record sports, overlay live scores, control a camera from another device, clip highlights, stream to third-party platforms, and publish temporary live score follow links. Features may vary by subscription tier and device role.
License
We grant you a personal, non-exclusive, non-transferable, revocable license to use ScoreMark for lawful game-day and related sports media purposes, subject to these Terms and Apple’s App Store terms.
Subscriptions and billing
Paid plans (including Live Stream and Pro) are sold as auto-renewing subscriptions through Apple. Payment is charged to your Apple ID. Manage, change, or cancel in your Apple ID subscription settings. Refunds are handled by Apple under Apple’s policies. Prices shown in marketing materials are in USD and may differ by region in the App Store.
Acceptable use
You agree not to:
- Use the Service to harass, threaten, or unlawfully record or broadcast others.
- Stream or publish content you do not have rights to share, including content involving minors without required consent.
- Abuse, overload, or reverse-engineer the live score APIs, scrape follow links at scale, or attempt unauthorized access.
- Interfere with other users’ games, devices, or streams.
- Misrepresent ScoreMark as affiliated with a league, school, or platform without permission.
Third-party platforms
Streaming to YouTube, Twitch, Facebook, X, or other destinations is subject to those platforms’ terms, community guidelines, and technical limits. ScoreMark is not responsible for account suspensions, key resets, or platform outages.
Live scores and connectivity
Live score follow pages and remote control depend on network conditions, Bluetooth range, and device permissions. Scores and clocks are provided as-is for convenience and may be delayed or unavailable. Do not rely on ScoreMark as the sole official timing system for sanctioned competition unless your organization explicitly allows it.
Your content
You retain rights to footage and scores you create. You grant us a limited license to host temporary score snapshots you choose to publish via follow links, solely to operate that feature.
Disclaimer
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE RECORDING, STREAMING, OR SCORE DELIVERY.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR SUPPLIERS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR SCOREMARK SUBSCRIPTIONS IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) USD $50.
Termination
You may stop using ScoreMark at any time. We may suspend or limit access if you violate these Terms or abuse the Service. Provisions that by nature should survive (including disclaimers and limitations) will survive termination.
Changes
We may update these Terms. The “Last updated” date will change when we do. Material changes may be noted in the app or on the site. Continued use after changes constitutes acceptance.
Governing law
These Terms are governed by the laws of the United States and the State of Texas, excluding conflict-of-law rules, unless mandatory local consumer law in your place of residence provides otherwise. Courts in Texas have exclusive jurisdiction for disputes that are not required to be heard elsewhere by law.
